COVID-19 Limitation of Liability and Acknowledgement of Risk

**CultureCon reserves the right to change any provisions under this COVID-19 Provision at any given time.**

By purchasing or receiving an admission ticket(s), and in consideration for being able to visit and/or participate in activities and/or events hosted by CultureCon LLC, I agree, understand, and acknowledge, on my own behalf and on behalf of any individual who uses a ticket or reservation made by me, as follows (collectively, the “COVID-19 Provision”):

 

Proof of Vaccination: Full COVID-19 vaccinations, as defined by the CDC, are required for all Guests (ages 16 and up). Proof of COVID-19 vaccination of all guests will be verified by the Released Parties upon in-person registration at CultureCon event(s). Guests with qualifying medical conditions that prohibit them from receiving full COVID-19 vaccinations must provide supporting documentation in advance of registration to receive admission and may also be required to provide a negative COVID-19 test within 24 hours of the start of the event.

 

Face Coverings: Pending any current or future mask orders enforced by the Dane County Public Health Office, face coverings will be required for all Guests (ages 2 and up) in all indoor public locations, including but not limited to hallways and restrooms, regardless of vaccination status. Face coverings are optional for Guests in outdoor locations and indoor private locations, such as ballrooms and breakout rooms.

 

All face coverings (whether disposable or reusable) should:

  • Be made with at least 2 layers of breathable material

  • Fully cover the nose and mouth and secure under the chin

  • Fit snugly but comfortably against the side of the face

  • Be secured with ties or ear loops and allow the Guest to remain hands-free

At this time, based on guidance from health authorities, neck gaiters, open-chin, triangle bandanas and face coverings containing valves, mesh material or holes of any kind are not acceptable face coverings.

Acknowledgement of Risk: I acknowledge that an inherent risk of exposure to the disease COVID-19 (as defined by the World Health Organization and any strains, variants, or mutations thereof) and SARS-CoV-2 (the virus that can cause COVID-19) (collectively, “COVID-19”) exists in any public place where people are present. COVID-19 is an extremely contagious communicable disease that can lead to severe illness and death. No precautions can eliminate the risk of exposure to COVID-19, and the risk of exposure applies to everyone.  I acknowledge that the risk of exposure to COVID-19 and any other communicable or infectious disease includes the risk that I will expose others that I later encounter, even if I am not experiencing or displaying any symptoms of illness myself. By visiting and/or participating in activities at CultureCon, I agree to voluntarily assume any and all risks in any way related to exposure to COVID-19, including illness, injury, or death of myself or others, and including without limitation, all risks based on the sole, joint, active or passive negligence of any of the Released Parties, named below. I acknowledge that my visit and participation are entirely voluntary.

 

Limitation of Liability: I agree and acknowledge that CultureCon shall not be liable for any damages suffered by me due to exposure to COVID-19 at any CultureCon event(s), including any and all liability, claims, causes of action, damages, costs, or expenses of every kind, including all claims and causes of action based on the sole, joint, active or passive negligence of any of the Released Parties, arising out of or in any way relating to exposure to COVID-19 during my visit to and/or participation in activities at CultureCon. This limitation of liability and the assumption of risk set forth above is intended to be as broad and inclusive as is permitted by law.

 

Released Parties: The Released Parties are: CultureCon LLC and their respective parents, subsidiary, and other affiliated or related companies, and all officers, directors, employees, shareholders, members, agents, contractors, sub- contractors, representatives, successors, assigns, insurers, and volunteers of each of the foregoing entities.

 

Binding Arbitration: I agree that, upon election by either party, any dispute, claim, or controversy arising under or relating in any way to this COVID-19 provision or exposure to COVID-19 during my visit to and/or participation in activities at CultureCon, now or in the future, will be resolved by binding arbitration before a single arbitrator appointed by the American Arbitration Association.  The arbitration will be held in Madison, WI.   

 

Governing Law: These terms and conditions, including the COVID-19 Provision, shall be governed by the laws of the State of Wisconsin.
